Motorcycle accident wrongful death lawsuits are often filed in cases where a motorcycle accident has led to a fatality, and the motorcyclist was not at fault for the accident. Such lawsuits can be filed by relevant parties. Such lawsuits are further discussed on the “Motorcycle Accident Wrongful Death Lawsuits” page.
As seen on that page, there are many reasons as to why a fatal motorcycle accident can occur. Many of these accidents are outside of the control of the motorcyclist, even if the motorcycle rider is riding in a lawful and careful manner. While there are many motivations as to why wrongful death lawsuits are filed, a primary reason is to seek to punish negligent and/or reckless behavior that has caused the person(s) to be fatally injured.
The January 25, 2019 Joliet Patch article titled “Wrongful Death Suit: Weber Road Motorcycle Fatality” discusses a wrongful death lawsuit that has been filed in connection with a fatal collision involving a U-turn on October 29, 2018. This fatal motorcycle accident was initially discussed in the “Crest Hill Motorcycle Accident On Weber Road Near Ryan Drive” post.
As seen in the Joliet Patch article, the lawsuit claims the defendant (Victor Zack) acted negligently, and “abruptly” decided to make a U-turn near the Crest Hill intersection of Ryan Drive, which led to a collision and the death of motorcyclist Clifford Ragland.
An excerpt from the January 25 Joliet Patch article:
The lawsuit accuses Zack of several counts of negligence including having “failed to keep a lookout in the direction of travel” and having “turned his vehicle so as to proceed in the opposite direction with such movement could not be made in safety and without interfering with other traffic …”
As noted in the article, at the time the article was written, the defendant (Victor Zack) had not been issued any traffic citations nor had any criminal charges been filed.
