Motorcycle-SUV Collision In Mascoutah, IL

There was a motorcycle-SUV collision Friday (August 4, 2017) in Mascoutah.  The collision occurred near Mascoutah High School.  The passenger on the motorcycle suffered critical injuries as a result of the collision.

An excerpt regarding the accident, as seen in the August 4, 2017 bnd.com article titled “Motorcyclist airlifted to hospital after collision with SUV,” quoting Mascoutah Police Sergeant Kevin McGinnis :

A red SUV stopped at a stop sign on North County Road and pulled out, striking the side of a motorcycle going westbound on Illinois 77 with two passengers, McGinnis said. Neither the driver of the SUV nor the driver of the motorcycle was injured.

“Likely the driver of the SUV will be ticketed on one or more violations,” McGinnis said. “It’s still under investigation, but he is at fault.”

Wrongful Death Lawsuit Filed Regarding Fatal Springfield Motorcycle Collision

On September 17, 2016 there was a fatal motorcycle accident in Springfield.  [The accident is summarized in the September 17, 2016 post titled “Springfield Collision Seriously Injures Motorcyclist And Passenger.”]  The collision involved a motorcycle with passenger and a SUV.  The motorcyclist and passenger (identified as Nathan M. Gulley, 17, of Moweaqua and Isaiah M. Tuppince, 16, of Assumption, respectively) were both seriously hurt, sustaining life-threatening injuries in the crash.  Both later died from their accident injuries.

There has been a wrongful death lawsuit filed with regard to the accident.  The plaintiff is Tuppince’s mother, Monica Brown.

The wrongful death lawsuit is discussed in the March 14, 2017 sj-r.com article titled “Lawsuit filed against Uber in fatal Springfield motorcycle crash.”  An excerpt:

The lawsuit claims the surviving driver, Michael A. Robinson of Chatham, was working for Uber at the time of the crash and may have been distracted by the ride-sharing company’s application on his cell phone.

Nathan Gulley, 17, of Moweaqua and Isaiah Tuppince, 16, of Assumption died when the motorcycle they were riding and Robinson’s sport utility vehicle collided at Ninth Street and South Grand Avenue.

Monica Brown, Tuppince’s mother, is seeking more than $50,000 in damages each from Robinson; Gulley’s mother, whose son was driving the motorcycle; and Uber.

Teresa Gulley is named in the suit on behalf of her son, who, the lawsuit claims, was driving over the speed limit.

As mentioned in the article, no citations were issued to Robinson at the time of the crash.   The investigation into the crash is continuing.

Wrongful Death Lawsuit Regarding Batavia Motorcycle Crash

In the August 5, 2016 post (“Fatal Motorcycle Collision In Batavia“) an August 4 fatal motorcycle collision was summarized.  In short, a collision occurred after a teenage driver made a left-hand turn immediately in front of a motorcycle, and a collision occurred.  The motorcyclist, Justin Retherford-Speer, 20, of Oswego, died from his accident injuries.  The teenage driver was later cited for failure to yield while turning left.

Car-Motorcycle Collisions When Motorists Cross The Center Line

An ongoing hazard to motorcyclists has been when oncoming vehicles cross the center line and, by coming into the opposing lane, strike a motorcycle or motorcycles.  These types of crashes, often resulting in a head-on collision, has been seen in a number of recent Illinois motorcycle accidents.  As is often the case in such head-on collisions, accident injuries sustained during such crashes are often life-threatening, and in many cases lead to the death of the motorcyclist and, if applicable, passenger.

There are many reasons that oncoming vehicles may cross the center line, and come into the motorcyclist’s lane.  One reason is distracted driving…i.e. some type of distraction leads the motorist to stray or otherwise come into the opposite lane.  Another prominent reason is when the motorist is impaired (DUI) on alcohol and/or drugs.

On May 6, 2016 a motorcycle collision like that discussed above, in which an oncoming motorist allegedly crossed the center line while intoxicated, occurred.  That motorcycle accident – which led to the later death of the motorcycle passenger (Amy Thornton, 42, of Woodstock) as well as injuries to the motorcyclist (Mike Thornton, 39, of Woodstock) – was initially discussed in the May 6, 2016 post titled “Motorcycle Crash In McHenry, Illinois.”

Subsequent information concerning the crash has been discussed in various media sources, including the July 24, 2016 Chicago Tribune article titled “Suspect in motorcycle death back in McHenry County after missing court date” as well as the July 26 Northwest Herald article titled “Wisconsin woman pleads not guilty in crash that killed Woodstock mom.”

An excerpt from the Chicago Tribune article with regard to the injuries the Thorntons had from the motorcycle accident, as well as the alleged impairment of the driver (Sheree Shaw, 45, of Twin Lakes, WI):

Mike Thornton, 39, was seriously injured in the collision, suffering a broken pelvis and shattered elbow.

Amy Thornton, 42, died nine days later of her injuries. Toxicology tests showed that Shaw had heroin in her system at the time of the crash, according to McHenry County authorities and court documents.

Two excerpts from the Daily Herald article regarding the charges faced by Shaw:

A Wisconsin woman formally denied allegations that she was under the influence of heroin during a McHenry crash that seriously injured a motorcyclist and killed his passenger.

also:

Shaw pleaded not guilty to two counts of aggravated DUI, Class 2 felonies and two counts of aggravated DUI, Class 4 felonies. If convicted, Shaw faces three to 14 years in prison on the Class 2 felonies and one to 12 years on the Class 4 felonies.
